Last year preparing a Deed of Variation for the estate of an unmarried couple which resulted in the children of the deceased being able to benefit from the Residential Nil Rate Band and meaning there were extra tax allowances available and no Inheritance Tax to pay as a result.
Recently prepared a Deed of Variation on an ongoing matter where two family members died in quick succession of one another, which will reduce the Inheritance Tax payable on the estate of the second to pass substantially, if accepted by HMRC.
Dealing with an estate where the first spouse to die had a Nil Rate Band Discretionary Trust in their Will and liaising with other team members regarding a separate issue of a legal charge on the matrimonial home, meaning interest was charged on the asset, which in turn reduced the Inheritance Tax payable. Beneficiaries were advised to liaise with an accountant as any tax payable on the gain could potentially be mitigated and any tax payable would not be as high the Inheritance Tax.
Preparation of Discretionary Trust Wills where a vulnerable beneficiary is involved or may not be financially responsible such as gambling addiction etc to enable funds for their benefit to be properly managed, in turn ensuring matters are dealt with in a responsible manner. Advising clients of the formalities of the trust going forwards.
Preparation of Life Interest Wills not only for protecting children in the case of second marriages but potentially protecting half of the matrimonial home against care fees.
Recently seeing a client at a care home, who needed to sell her house urgently and ascertaining her capacity, as she had no close family and was not receiving support from Social Services. Client decided to appoint the firm as her professional attorneys.
